Our Real Estate Practice Group provides a full range of corporate real estate services. Leveraging on their combined depth and breadth of experience, our lawyers in this practice have provided significant advice on many of the nation’s largest property transactions.

 

Property Management

We regularly advise developers as well as purchasers in respect of property management matters. These include common estate matters where the developer retains the control and management of the common property of the entire development (covering business, recreation, retail, and residence) including, infrastructure, utilities, and telecommunications.

We cover the following areas:

  • Sale and purchase agreements (purchase from Developers, secondary sales, and auction sales)

  • Loan financing for all types of property transactions

  • Easements and right of way

  • Transfers, leases, and tenancies

  • Sub-division and conversion of land titles

  • Transactions related to strata titles

  • The creation and the discharge of charges and liens

  • Obtaining FIC and State Authority’s Consent

  • All other forms of security documents and real property related transactions

  • Construction contracts, infrastructural projects, appointment of consultants and construction joint ventures.

  • Bumiputera quota releases 

 

Our achievements related to Strata Management Laws

  • Successfully recovering more than RM600,000.00 of maintenance charges on behalf of Vista Saujana Management Corporation in 2015/2016

  • Representing Neo Damansara Joint Management Body in recovering close to RM1,500,000.00 in maintenance charges from approximately 50 parcel proprietors

  • Successfully defended a class action suit against the Developer (Sin Chuan Hong (Terengganu) Sdn. Bhd.) for more than RM1,200,000.00 in damages by 17 parcel proprietors in 2017-2020. The 17 Plaintiffs appealed against the High Court’s decision, but HC successfully secured a victory at the Court of Appeal. Essentially, the Plaintiffs claimed that the Mezzanine Floor in the condominium was common property, but this claim was disallowed by the High Court. (Tan Siew Choon dan lain-lain v. Sin Chuan Hong (Terengganu) Sdn. Bhd. dan satu lagi [2020] MLJU 2181) .The Firm also prevailed in the Court of Appeal

  • From 2019 till to date, representing Vista Amani Joint Management Body for the recovery of maintenance charges

  • Currently representing Pangsapuri Sri Wangi Management Corporation against two tribunal claims by parcel proprietors seeking to gain advantage over common property

  • Just appointed in 2022 to handle all litigation proceedings for Venice Hill Management Corporation

  • Successfully obtained a court order in 2023 against 2Twelve Management Corporation ordering them to revise their rates from 2012 thus effectively recovering approximately RM900,000.00 in unpaid maintenance fees
